1. Overview

These Terms of Service govern your access to and use of the MALVICE website, online store, products, and related services.

Throughout these Terms, “MALVICE,” “we,” “us,” and “our” refer to the business operating under the MALVICE name. “You” and “your” refer to anyone who visits our website or purchases from us.

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products. Your purchase is made from MALVICE, not Shopify.

By visiting our website, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Return and Refund Policy.

If you do not agree with these Terms, you must not use our website or services.

2. Eligibility

You must be at least the age of legal majority in your country or have permission from a parent or legal guardian to use our website and place an order.

By using our services, you confirm that the information you provide is accurate and that you are legally permitted to enter into a purchase agreement.

3. Accounts

You may be able to create a customer account. You are responsible for:

Providing accurate and current information
Protecting your account credentials
Restricting access to your account
All activity conducted through your account

We may suspend or close accounts involved in fraud, abuse, unlawful conduct, or material violations of these Terms.

4. Products and Product Information

We make reasonable efforts to display product descriptions, sizing, colors, materials, photographs, and prices accurately.

However, colors may appear differently depending on your screen, lighting, and device settings. Minor variations in color, print placement, texture, or finish may also occur during production. These minor variations are not considered defects unless the product materially differs from its description.

Customers are responsible for reviewing the product description and size guide before ordering.

Products may be changed, discontinued, or limited in quantity. Availability is not guaranteed until an order is accepted.

Nothing in this section limits your rights if a product is defective, materially different from its description, or otherwise fails to meet mandatory consumer guarantees.

5. Prices and Payments

Prices are displayed in the currency selected or shown on the website. Applicable taxes, shipping charges, customs fees, or other costs will be displayed at checkout where required and reasonably possible.

We may change product prices at any time, but price changes will not affect orders already accepted unless you expressly agree or applicable law requires otherwise.

Payment must be successfully authorized before an order can be processed. Payments may be handled by Shopify Payments or other third-party payment providers.

You agree to provide accurate billing, payment, and contact information and confirm that you are authorized to use the selected payment method.

If we discover an obvious pricing or product-information error before dispatch, we may contact you and offer the choice of confirming the order at the correct price or cancelling it for a full refund.

6. Orders and Acceptance

Submitting an order represents an offer to purchase the selected products.

Receiving an automated order acknowledgment does not always mean that an order has been finally accepted. We may decline or cancel an order for a lawful reason, including:

Product unavailability
Suspected fraud or unauthorized payment
Incorrect pricing or product information
Shipping restrictions
Unusually large quantities or suspected unauthorized resale
A violation of these Terms

If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.

We reserve the right to limit quantities per person, household, account, payment method, or shipping address when reasonably necessary.

7. Order Changes and Cancellations

Contact support@malvice.com immediately if you need to change or cancel an order.

Because processing or production may begin shortly after an order is submitted, we cannot guarantee changes or cancellations once fulfillment has started.

Any statutory cancellation or withdrawal rights available to you remain unaffected.

8. Shipping and Delivery

Shipping destinations, processing times, estimated delivery times, tracking, customs information, and procedures for delayed or missing packages are explained in our Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed date.

Some items may be prepared or shipped from different fulfillment locations and may arrive in separate packages.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error.

9. Returns, Exchanges, and Refunds

Returns, exchanges, damaged items, cancellations, and refunds are governed by our Return and Refund Policy.

Nothing in these Terms limits any mandatory consumer rights, legal guarantees, cooling-off periods, or remedies available under applicable law.

10. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions, expiration dates, product exclusions, minimum order values, or usage limits.

Unless expressly stated otherwise:

Only one discount code may be used per order
Discounts cannot be applied retroactively
Discounts have no cash value
Promotional offers cannot be transferred or resold
Expired promotions will not be reinstated

We may cancel or correct a promotion affected by fraud, technical errors, or unauthorized use, provided this does not unfairly affect an order already accepted.

11. Intellectual Property

The MALVICE name, logos, designs, product graphics, slogans, photographs, videos, website layout, text, and other original content are owned by or licensed to MALVICE and are protected by applicable intellectual-property laws.

You may use our website for personal, non-commercial shopping purposes only.

Without written permission, you may not:

Copy, reproduce, modify, or distribute our content
Use our designs or branding on other products
Sell or commercially exploit our photographs or product graphics
Scrape, harvest, or systematically collect website content
Suggest an affiliation with or endorsement by MALVICE
Remove copyright, trademark, or ownership notices

12. Customer Reviews and Submitted Content

If you submit a review, photograph, comment, suggestion, or other content, you retain ownership of your original content.

You grant MALVICE a non-exclusive, worldwide, royalty-free license to display, reproduce, adapt, and share that content in connection with our website, products, customer communications, and marketing.

You confirm that:

You own the content or have permission to submit it
The content is truthful and based on a genuine experience
The content does not violate anyone’s rights
The content is not unlawful, threatening, discriminatory, deceptive, defamatory, or malicious
The content does not contain malware, spam, or unauthorized advertising

We may moderate or remove submitted content that violates these Terms or applicable law.

Third-party services may be governed by their own terms and privacy policies. MALVICE is not responsible for independent third-party websites or services outside our reasonable control.

This does not limit our responsibility for fulfilling your order or any liability that cannot legally be excluded.

15. Privacy and Communications

Our collection, use, and sharing of personal information are explained in our Privacy Policy.

By placing an order, you agree to receive necessary transactional communications, including order confirmations, shipping updates, security notices, and customer-service messages.

Marketing messages will be sent only as permitted by law. You may unsubscribe from promotional emails at any time using the unsubscribe link or by contacting us.

16. Website Availability and Accuracy

We aim to keep our website available, accurate, and secure, but uninterrupted access cannot be guaranteed.

We may temporarily suspend or modify parts of the website for maintenance, security, technical problems, or improvements.

We may correct typographical errors, inaccuracies, or omissions. Corrections will not remove rights that you already have under an accepted order or applicable consumer law.

To the maximum extent permitted by law, MALVICE will not be liable for indirect or unforeseeable losses resulting from use of the website.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

Intentional misconduct or gross negligence
Death or personal injury caused by negligence
Defective or unsafe products where liability cannot be excluded
Breach of mandatory consumer rights
Any other liability that cannot legally be limited

For consumers, MALVICE remains responsible for losses that are a reasonably foreseeable result of our breach of these Terms.

19. Indemnification

To the extent permitted by law, you agree to compensate MALVICE for reasonable losses, claims, or expenses resulting directly from your unlawful misuse of the website, infringement of another person’s rights, or material violation of these Terms.

This provision does not apply where the loss was caused by MALVICE or where enforcement would conflict with mandatory consumer law.

20. Events Outside Our Control

We are not responsible for delays caused by events outside our reasonable control, such as severe weather, natural disasters, carrier disruptions, customs delays, labor disputes, government action, war, civil unrest, internet outages, or supply-chain interruptions.

If such an event materially affects an order, we will contact you and provide the options required by applicable law, which may include a revised delivery estimate or cancellation and refund.

21. Suspension and Termination

We may suspend or terminate access to our services if you materially violate these Terms, misuse the website, threaten its security, or engage in fraudulent or unlawful activity.

Termination does not affect rights or obligations that arose before termination, including payment, delivery, refund, and consumer-protection obligations.

We may update these Terms when our services, business practices, or legal obligations change.

Updated Terms will be posted on this page with a revised “Last updated” date. Changes apply prospectively and will not materially alter an already accepted order unless required by law or agreed with you.

23. Governing Law and Consumer Rights

To the extent permitted by law, these Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules.

If you are a consumer, you continue to benefit from any mandatory protections provided by the laws of your country or region. Nothing in these Terms prevents you from bringing a claim in any court or forum available to you under applicable consumer law.

Before beginning formal proceedings, we encourage you to contact support@malvice.com so we can attempt to resolve the matter fairly.

24. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

25. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

26. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any additional conditions presented during checkout, form the agreement between you and MALVICE regarding your use of our store and purchases.
